The court must dismiss the subsequent suit if the matter in issue is also directly in issue in a previously instituted suit. The court is barred from staying a suit if the previously instituted suit is pending in a foreign court. The court is required to stay the trial of a subsequent suit, but is not barred from passing interim or interlocutory orders. The stay of suit applies even if the parties in the two suits are entirely different and claiming under different titles.
